1. Acceptance of Terms

By accessing or using Oceanalytic ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.

2. Description of Service

Oceanalytic provides privacy-friendly web analytics software as a service. The Service includes a tracking script, analytics dashboard, UTM link builder, event tracking, team collaboration features, and related tools. We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice to active subscribers.

3. Your Account

  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.
  • You must not share your account with others or allow others to access the Service through your credentials.
  • You must notify us immediately at hello@oceanalytic.io if you suspect any unauthorized use of your account.
  • You must be at least 16 years old to create an account.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You may not use Oceanalytic to:

  • Track websites, apps, or digital properties you do not own or do not have explicit permission to track.
  • Collect sensitive personal data — including health information, financial data, government identification numbers, or data relating to minors — through our tracking script.
  • Attempt to reverse-engineer, decompile, scrape, or otherwise abuse the Service infrastructure or APIs.
  • Resell, sublicense, or white-label access to the Service without prior written permission from Oceanalytic.
  • Introduce malware, viruses, or any code intended to disrupt or damage the Service or its users.
  • Circumvent usage limits, rate limits, or access controls.

We reserve the right to suspend or terminate accounts that violate these rules without prior notice.

5. Plans & Billing

  • The Free plan is subject to the event, project, and team member limits stated on the pricing page. Exceeding these limits may result in data collection being paused until the next billing cycle.
  • Paid plans are billed monthly or annually in advance via Stripe. All prices are in USD.
  • You may upgrade, downgrade, or cancel your plan at any time from your account settings. Downgrades and cancellations take effect at the end of the current billing period.
  • No refunds are issued for partial billing periods or unused time on a plan.
  • We reserve the right to change pricing with at least 30 days' notice to active subscribers. Continued use after the notice period constitutes acceptance of the new pricing.
  • Failed payments may result in temporary suspension of paid features until payment is resolved.

6. Data Ownership & Privacy

You retain full ownership of the analytics data collected for your projects. Oceanalytic acts as a data processor on your behalf. We do not sell, rent, or share your data with third parties except as strictly necessary to operate the Service (e.g. payment processing via Stripe, email delivery via Resend).

Our tracking script does not use cookies and does not collect personally identifiable information from your website visitors. A lightweight visitor identifier is stored in localStorage on the visitor's browser solely to distinguish unique visits. For full details, see our Privacy Policy.

Upon account deletion, your analytics data will be permanently removed within 30 days.

7. Team Members & Collaboration

Project owners may invite team members to access their projects. The number of team members per project is subject to your plan limits. Invited members may view analytics data but cannot modify project settings, billing, or invite additional members unless explicitly granted permission by the owner.

Project owners are responsible for the actions of their team members within the Service. Removing a team member revokes their access immediately.

8. Intellectual Property

The Oceanalytic name, logo, dashboard interface, and all associated software are the intellectual property of Oceanalytic and its licensors. You may not copy, modify, distribute, or create derivative works based on the Service without our express written consent.

You grant Oceanalytic a limited, non-exclusive license to process your data solely for the purpose of providing the Service to you.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Oceanalytic shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of profits, data, or goodwill — arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claims arising out of or relating to these Terms or the Service shall not exceed the total amount you paid us in the three (3) months immediately preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless Oceanalytic and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your use of the Service, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, if we reasonably believe you have violated these Terms or if required by law. You may delete your account at any time from your account settings. Upon termination, your right to use the Service ceases immediately.

13. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising under these Terms shall be resolved through good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to binding arbitration or the courts of competent jurisdiction.

14. Changes to Terms

We may update these Terms from time to time. We will notify active users of material changes via email or a prominent notice in the dashboard. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms.
